Terms of Service

1. Service Description

Nawaconnect (“the Service”) is a web-based platform that enables businesses to create mobile-optimized booking pages connected to WhatsApp. The Service is operated by Nawaconnect (“we”, “us”, “our”).

Nawaconnect is not affiliated with, endorsed by, or sponsored by WhatsApp Inc. or Meta Platforms, Inc.

2. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Violate WhatsApp's Business Policy or applicable anti-spam laws
• Post illegal, harmful, or offensive content
• Impersonate any person or entity
• Distribute spam, malware, or phishing content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service

We reserve the right to suspend or terminate accounts that violate these terms.

4. Content Ownership

You retain ownership of all content you upload to the Service, including business information, images, and menu items. By uploading content, you grant us a limited license to display and distribute that content solely for the purpose of operating the Service.

5. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or changes that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

The Service is provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding the Service's reliability, availability, or fitness for a particular purpose.

6. Pricing

The Service is currently offered free of charge. We may introduce paid plans in the future. If we do, we will provide at least 30 days' notice before any charges apply. Prices will be listed in US dollars (USD).

7. Limitation of Liability

To the maximum extent permitted by law, Nawaconnect shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total aggregate liability for any claims arising from your use of the Service shall not exceed the total amount you have paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

8. Indemnification

You agree to indemnify and hold harmless Nawaconnect and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

9. Third-Party Dependencies

The Service relies on third-party platforms, including WhatsApp, for core functionality. We are not responsible for changes, outages, or restrictions imposed by third-party providers. If WhatsApp or any other third-party service becomes unavailable or restricts your access, we are not liable for any resulting disruption to your use of the Service.

10. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms or if required by law. Upon termination, your data will be deleted within 30 days unless retention is required by law.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Delaware.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
